1. Provider Information

Provider in the sense of German law (including § 5 TMG / future DDG obligations) is:

2. Scope and Acceptance

These Terms govern use of Arcane services through Discord and the Arcane web dashboard. By creating an account, starting a trial, or purchasing paid access, you agree to these Terms.

3. Contract Formation and Contract Language

  • Service descriptions and prices shown at checkout are invitations to place an order.
  • A binding contract is formed when Arcane confirms your purchase/activation.
  • Contract language is English unless otherwise stated.

4. Service Description

Arcane provides online automation-related services and license-based access. Services may include trial access, paid license durations, and account/instance management.

  • Each paid license generally grants access to one bot instance.
  • Multiple concurrent instances require multiple valid licenses unless expressly agreed otherwise.
  • Feature scope, compatibility, and service availability may change over time.

5. Prices, Payment, and Taxes

  • Prices shown at checkout apply at the time of purchase.
  • Accepted payment methods may include PayPal and selected cryptocurrency options.
  • Any applicable VAT/sales tax treatment follows mandatory law at purchase time.
  • You are responsible for currency conversion and payment-provider fees unless stated otherwise.

6. Consumer Right of Withdrawal (Widerruf)

If you are a consumer under § 13 BGB, statutory withdrawal rights for distance contracts may apply. Details are provided in the Refund Policy.

7. User Obligations

  • You must provide accurate data and keep account credentials secure.
  • You must comply with applicable law and third-party platform/game terms.
  • You must not abuse services, bypass restrictions, or engage in fraud or harassment.
  • Violations may result in suspension or termination of access.

8. Risk Disclosure

Arcane cannot guarantee prevention of platform/game warnings, restrictions, or bans. Use of automation services carries inherent enforcement risk. This does not limit any mandatory statutory rights.

9. Service Availability and Changes

Arcane may update or modify service features where reasonably necessary (for technical, security, legal, or operational reasons). Material changes will be communicated where required by law.

10. Liability (Haftung)

Arcane is liable without limitation in cases of intent (Vorsatz), gross negligence (grobe Fahrlassigkeit), injury to life/body/health, and where mandatory product liability law applies.

In cases of slight negligence, Arcane is liable only for breach of essential contractual obligations (Kardinalpflichten), limited to foreseeable typical damage. Mandatory statutory rights remain unaffected.

11. Term, Suspension, and Termination

Access lasts for the purchased term unless terminated earlier for cause. Arcane may suspend or terminate access for material breaches, security risks, fraud, abuse, or legal obligations.

12. Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, mandatory consumer protection provisions of your country of residence remain unaffected.

For merchants (Kaufleute), the exclusive place of jurisdiction is the provider's registered seat, where legally permissible.

13. Consumer Dispute Resolution

  • Statement under § 36 VSBG: We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Changes to These Terms

Arcane may update these Terms. Updated Terms become effective on publication with a revised date, without prejudice to mandatory legal notice/consent requirements.
